Elaine Peck v. Long Beach Medical Center, et al.
This is a class action lawsuit filed in the Supreme Court of New York in Mineola.

ISSUES
The lawsuit alleges breach of contract, unjust enrichment, and other violations for the defendants’ refusal to pay their employees compensation owed to them for accrued benefits, including vacation pay, longevity time, overtime, personal time, and sick pay.
PLAINTIFFS
The Plaintiffs are former employees of Defendant Long Beach Medical Center that have been laid off and/or otherwise have resigned.
DEFENDANTS
The Defendants are Long Beach Medical Center and its CEO, Douglas Melzer.
MILESTONES
- Plaintiffs have achieved from the Supreme Court a preliminary injunction against Defendants, which prevents Defendants from transferring or otherwise disposing of their property until a hearing is held before the Court.
- Plaintiffs also recently filed a Motion for Attachment under CPLR 6201, which seeks to attach Defendants property in Long Beach, NY and prevent Defendants from transferring their property until completion of the instant lawsuit.
- Motion papers concerning Plaintiffs’ motion will be submitted to the Court for review in the beginning of February.
