ISSUES
The lawsuit alleges breach of contract, false advertising, and unfair trade practices for the defendants’ false and misleading advertising in connection with their advertising, marketing and sale of FRS energy drinks, chews, and products.
PLAINTIFFS
The Plaintiffs are a nationwide class consisting of all purchasers of Defendants’ products that were subject to Defendants’ false and misleading misconduct.
DEFENDANTS
The Defendants are FRS Energy and Lance Armstrong, who was a member of FRS’ board of directors and an active part of the organization.
MILESTONES
- Plaintiffs’ have fully briefed and submitted opposition papers to the motion to dismiss the lawsuit filed by the defendants in the case.
- The motion and opposition papers were submitted to the District Court at the end of October, 2013, and is currently under review by the Court.
- A decision by the Court on the motion to dismiss is expected soon.
